Y es — on behalf of the Department of Homeland Security, Secretary Kristi Noem has issued a new determination that effectively terminates the collective bargaining agreement between AFGE and TSA covering approximately 47,000 Transportation Security Officers and ends formal union representation under the current framework. This move follows an earlier determination that was blocked by a federal court and represents the administration’s latest effort to roll back union rights for TSA officers. AFGE has denounced this action as unlawful and retaliatory and is pursuing legal challenges 


 Right now, the legality of Secretary Noem’s action is very much in dispute and is being challenged in court. The Department of Homeland Security (DHS) under Kristi Noem has issued a new determination terminating the TSA collective bargaining agreement and plans to implement changes effective January 11, 2026, including stopping union dues deductions and ending the existing contract. However:

  • AFGE has repeatedly said the move is illegal and is pursuing legal action, calling it “retaliatory union-busting” and arguing the Secretary lacks authority to unilaterally cancel an already authorized, multi-year contract. AFGE
     
  • A federal judge previously blocked an earlier attempt to strip union rights and enforce the contract termination. That preliminary injunction was issued in June 2025 and shows the judiciary is willing to intervene when agency actions appear unlawful. Government Executive
     
  • Because this issue is litigation-driven, the agency’s ability to enforce the January 11th timeline may be paused or reshaped by court rulings. Courts can block or delay enforcement if they find the action violates the law or prior court orders — and AFGE has signaled it will seek injunctions and other remedies. AFGE
     

In short: DHS has taken administrative steps toward a January 11 implementation, but whether that schedule actually goes into effect depends on ongoing court proceedings. The situation is fluid, and the union’s legal challenges could result in delays, reversals, or enforcement limitations as the litigation plays out.
